In these terms, we mean by:

Looqa.ai / we / us

Service

The Looqa.ai web application and mobile apps, including all features and integrations.

User / you

Any natural person who holds an account on Looqa.ai.

Account

The profile registered by you that gives you access to the Service.

Subscription

A paid plan (Pro or Studio) with extended functionality.

Content

All data uploaded or entered by you, including photos, clothing metadata and body scans.

By creating an account and using the Service, you agree to these terms and the privacy statement. Do not use the Service if you do not accept these terms.

• You must be at least 16 years old to create an account.
• You are responsible for keeping your password confidential and for all activity on your account.
• One person per account; accounts are not transferable.
• You provide accurate, up-to-date information (name, email address).
• We reserve the right to suspend or delete accounts in the event of abuse, fraud or serious violation of these terms.

Looqa.ai offers a SaaS service for managing a digital wardrobe. This includes, among other things: uploading clothing, AI categorisation, outfit suggestions, a virtual fitting room, analytics and subscription-gated features.

The AI output is an aid and never definitive. We do not guarantee that suggestions, categorisations or virtual fitting-room results are error-free. Use your own judgement when making purchases or style decisions. You can report inappropriate or incorrect AI results directly in the app; we review every report.

We aim for an availability of 99% per month, but cannot guarantee uninterrupted service (maintenance, external AI providers, etc.).

Looqa.ai has the following subscription plans:

• Prices are subject to change and include VAT, unless stated otherwise.
• Paid subscriptions renew automatically at the end of the chosen period until you cancel.
• We announce price changes at least 30 days in advance by email. You can then cancel before the effective date.
• Founding offer. While offered on the website, a one-time rate of €25 for the first year (Pro) applies for at most 25 founding members, with a money-back guarantee within that year. After the first year the subscription renews at the then-current regular yearly rate unless you cancel.

Payments are processed by Stripe Payments Europe, Ltd. We do not store card details ourselves. Payment is made in advance per period. If a payment fails you will receive three reminders; if payment remains outstanding we may suspend your account until the payment has been made.

Because Looqa.ai is a digital service that you use immediately, your statutory 14-day cooling-off period lapses as soon as you actively use paid features (such as the virtual fitting room). We inform you of this at the time of purchase.

Have you taken out a paid subscription but not yet used a Pro/Studio feature? Then you can withdraw from the agreement within 14 days. Send an email to hello@looqa.ai with your account name and we will process the refund within 14 days.

• You can cancel your subscription at any time via your settings (Manage subscription → Cancel subscription).
• After cancellation you retain access until the end of the period already paid for.
• We do not refund periods already paid for, except in the case of withdrawal (see section 07).
• Want to delete your entire account? You can do so via settings > Delete account, or without the app via looqa.ai/account/delete. All data is permanently erased within 30 days.

If you take out a paid subscription via the iOS or Android app, the purchase and payment are handled via the Apple App Store or Google Play, respectively. In addition to these terms, the terms of the relevant store also apply to those purchases.

• Automatic renewal. A subscription taken out via the store renews automatically at the end of each period, unless you cancel at least 24 hours before the end of the current period.
• Cancellation. You manage and cancel store subscriptions via your Apple ID (Settings → Subscriptions) or your Google Play account (Subscriptions), not via Looqa. We cannot cancel a subscription taken out via the store on your behalf.
• Refunds. Refunds for purchases made via the store are handled by Apple or Google, respectively, in accordance with their own refund policies; we have no control over this.
• Price changes. Changes to the price of a store subscription are announced in accordance with the rules of Apple/Google; you will have the opportunity to cancel before the change takes effect.
• Family Sharing. Sharing your subscription via Family Sharing is not (yet) supported.

All Content you upload (photos, metadata, body scans) remains your property. You grant Looqa.ai a limited, non-exclusive, worldwide licence to store, display and process this Content, solely to the extent necessary to provide the Service to you.

We never share your Content publicly without your explicit action (for example, by publishing an outfit to the community feed).

You are not permitted to:

• Upload illegal, hateful, violent or sexually explicit content.
• Infringe the copyrights of others (only upload photos you hold the rights to yourself).
• Use automated tools (scrapers, bots) except via our official API.
• Commercially resell AI output or Service data without written permission.
• Attack our infrastructure or exploit vulnerabilities (report these instead to security@looqa.ai).

The Looqa.ai name, the logo, the website and application code are the property of Looqa Technology B.V.. You are granted a personal, non-transferable right to use the Service for as long as your subscription runs.

Your Content remains yours. AI output generated on the basis of your Content (such as outfit suggestions or try-on images) may be used by you personally.

Looqa.ai is not liable for indirect damage, such as lost profits, missed savings or reputational damage. Our liability for direct damage is limited to the amount you paid us in the preceding 12 months.

This limitation does not apply in cases of intent, gross negligence or where the law does not permit limitation of liability (such as product liability or personal injury).

Looqa.ai is not liable for shortcomings that are the result of force majeure, such as outages at external providers (Supabase, Stripe, Google, Replicate, Vercel), natural disasters, strikes, war or pandemics. We do our best to resolve interruptions as quickly as possible.

We may amend these terms from time to time. We announce material changes at least 30 days in advance by email. If you do not agree with the changes you can cancel your subscription before they take effect.

These terms are governed by Dutch law. Disputes will be submitted to the competent court of the Noord-Holland District Court, unless mandatory consumer rules designate a different competent court.
